Identify US Customs Regulations That Apply to and Affect Your Operations.

All Countries regulate the movement of goods across their borders, for purposes of national security, consumer protection, and of course, as a source of federal revenue from import tariffs. Over 98% of all global trade is among and between member-nations of the World Trade Organization (“WTO”) – these member-nations also codify the global trading parameters into their own national regulations. In the US, Customs Duties requirements are promulgated from various Congressional Acts, to Title 19 of the US Code, and then codified in Title 19 Code of Federal Regulations (“CFR”).

Under the “Mod Act” all US importers have the legal responsibility to “exercise reasonable care” in all aspects of their importations. It is every US importer’s responsibility to know, understand, and lawfully abide by all applicable Customs regulations. Knowing, understanding, and properly embedding all applicable regulations to your activities are essential for a successful import operation.

In this session, expert speaker Randi S. Waltuck Barnett will identify the basic, and not-so-basic but most important concepts of Import law and regulations. You will know where these can be found in 19 CFR; how to use customs regulations in your own import activities to meet the legal standards; and identify some areas that are lesser known, and therefore potentially of high risk to your operations.

In this session Randi will also show you where to access the laws and regulations, as well as other supporting information that affect your ability to comply with the law. You will be guided on how to separate the hundreds of pages of regulations into those areas that are most important, those that don’t affect your operation, and those that might affect you without your knowing. In addition, you’ll be shown how some companies establish a Customs Compliance Program that references the applicable laws and regulations to prove that they’re exercising reasonable care as required. Lastly, Randi will share some best practices and lessons learned from decades of import compliance work across many verticals to help you proactively avoid trouble, and how to best handle any violations should they inadvertently occur.
