Stop Fraudulent Leave Now—and Minimize Collateral Damage

The Family and Medical Leave Act (FMLA) requires certain employers to provide job-protected employees with unpaid leave for designated medical and family reasons—including pregnancy, military service, foster care placement, adoption, and personal or family illness. While the act is a lifesaver for many workers, abuse is prevalent. One recent study suggested that one-third of all sick days were taken fraudulently, and abuses included leave to serve jail time, work a second job, and travel to exotic locations. The cost? In the billions, analysts say.

Susan Fahey Desmond has practiced labor and employment law since 1985. Join her as she shows you how to handle suspected abuse of family and medical leave. Desmond cautions that while most employees don’t abuse the system, the ones who do hurt your bottom line. She’ll show you how to identify the abuse and what you can do about it.

This audio event will show you how what types of leave are likely to be abused, how to use medical certifications to combat abuse, and what red flags hint at potential abuse. She’ll also show you how to conduct a property investigation, what to document and what not do document, how to discipline or terminate employees, and how to avoid retaliation claims after terminating an employee for leave abuse. Most importantly, she’ll help you cut losses and stay legal.
