There has been a sharp rise in the number of EEOC charges for disability discrimination in the past few years. We have also seen an unprecedented rise in litigation related to disability cases. Why is it so? The flood gates for disability claims have been opened due to the ADA Amendments Act, which was made official in 2011, and has changed the definition of “disability” far from what it used to be.

At present, the ADA is confusing especially for managers and supervisors who are required to interact everyday with employees in order to set behavioral and performance expectations. Also, HR professionals are required to advise managers as internal consultants on problems that are related to poor performance of employees that are mostly intertwined with reasonable accommodation and disability issues.
