Understand Your Compliance Obligations Regarding Employees with Disabilities

There has been a sharp rise in the number of EEOC charges for disability discrimination in the past few years. We have also seen an unprecedented rise in litigation related to disability cases. Why is it so? The flood gates for disability claims have been opened due to the ADA Amendments Act, which was made official in 2011, and has changed the definition of “disability” far from what it used to be.

At present, the ADA is confusing especially for managers and supervisors who are required to interact everyday with employees in order to set behavioral and performance expectations. Also, HR professionals are required to advise managers as internal consultants on problems that are related to poor performance of employees that are mostly intertwined with reasonable accommodation and disability issues.

Join this webinar by expert speaker Natalie Ivey to get a clear understanding about your compliance obligations in an easy-to-understand (non-lawyer lingo) language.  Seasoned HR Consultant and educator, Natalie Ivey, will take you through your compliance obligations and provide best practical guidance on what you need to do to comply with the ADA.

Session Highlights:

  • Understand the new ADA Amendments Act (ADAAA) and significant changes in identifying a qualified disability.
  • Understand your compliance obligations regarding employees with disabilities.
  • Determine if an employee has a qualified disability - and how to document appropriately.
  • Handle the balancing act of providing reasonable accommodations while also managing the business.
  • Manage the “sticky issues” like absenteeism, unreasonable requests and declining employee performance.
  • Identify employee “gamers” who are gaming the system after exhausting FMLA and now requesting accommodations.
  • Investigate a potential disability fraud issue in which an employee claims to be disabled; yet, the "grapevine" indicates the employee is just fine outside of work.
