How to Use the Federal Regulations for Electronic Form I-9 Systems to Vet Vendors’ Products

More and more employers are making the move to electronic Form I-9s and software programs to handle them in order to reduce errors and paper usage. However, the federal regulations related to Form I-9s contain very stringent and unforgiving requirements about what electronic I-9 systems must contain. A flaw in your electronic I-9 system could result in all of your Form I-9s being invalidated in the event of an I-9 audit and your business being fined for every single Form I-9. It’s crucial to understand the electronic Form I-9 requirements and to make certain that your current or future system is compliant in order to avoid fines.

Most businesses begin using electronic Form I-9s through their HR software programs that contain I-9 modules or claim to be “all in one” onboarding systems. But many of these systems do not meet the strict federal requirements for electronic I-9s.
