Decoding the Complex World of Internal Investigations to Reduce Employer's Liability

Let's face it: most HR professionals are dealing with a lot of employee complaints, almost every day. Here is just a quick snapshot of the complaints that come to HR:

  • "He's harassing me..."
  • "My work environment is extremely hostile..."
  • "She's a bully..."
  • "I'm not one of my boss's 'favorites', so I didn't get..."
  • "I didn't get the promotion because I'm..."
  • "He's just retaliating against me..."
  • "That write-up I got was so not fair...the only reason I got written up was because..."

The U.S. Supreme Court has opined that organizations are responsible for both the prevention and intervention of harassment of protected classes. One pivotal task organizations must take to abide by the Supreme Court's requirement is that a comprehensive investigation of complaints occurs. When the investigator has not been trained (training demonstrates "prevention" taken by the organization), even if they have been conducting investigations for their entire career, the risk is high that the investigation will not be done correctly which increases the employer's liability, and therefore the amount of damages paid to the plaintiff by the employer.

The Equal Employment Opportunity Commission (EEOC) directs employers who receive a complaint, or otherwise know of an alleged workplace harassment, to immediately and thoroughly investigate and take prompt and appropriate corrective action to end the harassment, provide the victim with employment opportunities and benefits, and prevent any further misconduct of that kind from happening again. That is a challenging task, no doubt, however it ensures that the harassment complaint is handled with fairness and justice, and organization strictly follow the law.

Perhaps, the investigation process is the most critical element in a harassment complaint. Mostly, cases that have gone to court were due to lack of inadequate investigations of complaints. As per EEOC, the cost to settle a sexual harassment case has increased by $50 million every year.
