With the emergence of more and more regulatory restrictions on products which are to be passed through federal, state and local governments, you need to understand as a retailer, what are the potential concerns that surround the various product offerings. The Federal Insecticide, Fungicide and Rodenticide Act (FIFRA), is the culmination of a century of regulations attempting to provide the public with information on the efficacy and safe usage of products designed as environmental poisons. Common products found in a retail setting include cleaning products, home health related products (such humidifiers), clothing designed to resist odors, bathroom products, pet care products, kitchen products, and home products (such as bedding). If something like, 'antibacterial,' 'mildew resistant,' 'protects from allergens,' 'sterilize' and such other pest claims are listed on the product, the product is subject to regulation. Products can be qualified to meet certain exemptions, or they can be registered or manufactured in a registered facility.
Retailers selling or distributing products that make disinfecting, sanitizing or pest mitigation claims (including mold and mildew) are regulated under FIFRA. Retailers are responsible for ensuring that products sold on their shelves are compliant and this becomes especially so when these products are under the retailer's private label.
