Payment provisions in construction contracts are more than simply the amount and when the payment will be made. In today’s construction contracts there are many provisions that directly affect how a party to the contract will be paid and that can easily be overlooked or misunderstood. For example, the pay-if-paid provision can shift the financial risk of non-payment from the contractor to a subcontractor. Likewise, the change order process can result in non-payment for work provided unless certain conditions are met or waived. A contractor or an attorney representing a contractor should know the various common contractual provisions that can delay, modify or eliminate payment for work performed.
