Project owners, design professionals, construction managers and contractors frequently ask if there are recommendations on how to avoid disputes on future construction projects.  They acknowledge that there is no such thing as a “claim free” project but are seeking ways close out projects without resorting to arbitration or litigation at the end of the project.  This webinar is based on a number of interviews with experienced practitioners in the construction industry.  The webinar is based on their experience, observations and thinking.  This webinar addresses the issues of claims mitigation and dispute avoidance during the planning, design, bidding, construction and claim phases of a project. 

These planning, design and bidding phases frequently lay the groundwork for future claims, claims that do not manifest themselves until construction is underway. The construction and claim phases of a project overlap each other as claims can start to arise shortly after Notice to Proceed is issued and even before physical construction starts.

In this session, expert speaker James G. Zack, Jr., CCM, CFCC, FAACE, FFA, FRICS, PMP will discuss the actions that owners, designers and construction managers can take to help avoid claims during construction or, should they arise, resolve them on the project site and not in arbitration or litigation.  This webinar identifies 9 actions owner project teams can take during the planning phase to help avoid claims during construction.  In this session, James will discuss 28 actions that owner teams can take during design to mitigate the potential for claims during construction.  He will also identify 6 actions which owners can take and 6 actions that bidders can take to avoid later claims.

In this session, James treats the claim phase of a project as dealt with herein separately, not because it takes place at a different point in time, but because the activities involved in preparing, submitting, receiving, reviewing and resolving claims are entirely different from those activities concerning management and delivery of a construction project. While the activities in the claim phase overlap and are concurrent with the activities of the construction phase, they are not the same and thus are treated separately.

This webinar is a sweeping review of ways and means to avoid or mitigate claims and disputes during the construction phase of a project.  This webinar is intended to provide you with a list of practical suggestions that can be implemented during the various phases of a construction project – planning, design, bidding, construction and claim.  The intent is to provide information to project participants that will provide multiple opportunities to avoid disputes or, should they arise, resolve these disputes as soon as possible and at the lowest level possible on the project.
